The federal appeals court has maintained a ban on deploying state troops in the Oregon city, after a latest court ruling.

Judicial Panel Agrees to Rehear Legal Matter

The federal appeals court ruled on Tuesday that it would reexamine the case concerning the president’s authority with an larger panel of eleven justices. The judicial body also vacated a earlier ruling from a smaller judicial group that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a long-running court case over whether the former president has the authority and justification to send state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was initiated in due to months of protests.

Conflicting Arguments

The federal government has claimed that federal officials at the immigration center in south Portland were under attack, while city and state officials maintain that municipal police have command of the circumstances.

Contrary to descriptions of Portland as a conflict zone, locals have been sharing videos of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in the city enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to circumvent the first order by calling up out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the second ruling stayed effective, blocking the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard by the full court – with all decisions under review together – by a group of eleven justices.

“This ruling shows that the truth matters and that the judicial system are working to ensure government responsibility. The constitution limits the president’s power, and local populations cannot be treated as a testing site for expansive government power,” said the state attorney general in a statement.

“The judicial body is sending a definite signal: the president cannot dispatch the armed forces into American urban areas without cause. We will continue defending state legislation, values, and autonomy as this case progresses and our legal battle continues in the courts.”
